Hongkou Introduces Entry-Approval System for the Construction Sector: Bids for Construction Projects Must Include Integrity Certificates

　　Engineering bidders who fail to provide authentic certificates of integrity will be disqualified from participating in tendering activities. On July 5, relevant authorities in Hongkou District announced the recent introduction of the “Integrity-Based Admission System for Construction Project Tendering and Bidding,” aimed at curbing official misconduct and corruption in the construction sector at the source.

　　The access-control system stipulates that for any engineering construction project financed by fiscal funds or other public funds in the amount of RMB 2 million or more (inclusive) and subject to mandatory public tendering in accordance with the law, bidders, in addition to submitting the documents required under relevant regulations, must also provide a certificate issued by the procuratorial organ at or above the county level in the location of the entity or the project site confirming the absence of any record of bribery-related criminal offenses, together with a description of the corresponding integrity-ensuring measures. Bidders who fail to provide such an integrity certificate shall be deemed to lack the requisite bidding qualifications.

　　According to the regulations, bidders are required to submit integrity certificates for the bidding entity and its legal representative, chairman, general manager, project manager, and other relevant personnel. The main content of these certificates includes whether the individuals have any records of bribery-related criminal offenses in the past three years, as well as information on the enterprise’s internal integrity management systems. The regulations further specify that the certification of whether or not there are any bribery-related criminal records shall be issued by the procuratorial organs through the “Bribery Crime Archive Inquiry System.” For bidders from other provinces or municipalities who encounter difficulties in conducting such inquiries within this district, they may submit a request for a bribery crime archive inquiry to the procuratorial organs at the enterprise’s place of registration, place of business, or place of household registration.
