Chapter 8: The Party’s Disciplinary Inspection Organs

　　Article 45 The Central Commission for Discipline Inspection of the Party shall conduct its work under the leadership of the Central Committee of the Party. The discipline inspection commissions at all local levels and at the primary level shall conduct their work under the dual leadership of the party committees at the corresponding levels and the higher-level discipline inspection commissions. Higher-level party discipline inspection commissions shall strengthen their leadership over lower-level discipline inspection commissions.

　　The term of office of each level of the Party’s disciplinary inspection commissions shall be the same as that of the corresponding Party committees.

　　The plenary session of the Central Commission for Discipline Inspection of the Party shall elect its Standing Committee, as well as its Secretary and Deputy Secretaries, and submit the results for approval by the Central Committee of the Party. The plenary sessions of local commissions for discipline inspection at all levels shall elect their Standing Committees, as well as their Secretaries and Deputy Secretaries, which shall then be approved by the corresponding party committees at the same level and submitted for approval by the higher-level party committees. Whether a primary-level party committee shall establish a commission for discipline inspection or appoint discipline inspection commissioners shall be decided by the next higher-level party organization in light of the specific circumstances. General branch committees and branch committees of the Party shall appoint discipline inspection commissioners.

　　The Party’s central and local discipline inspection commissions shall comprehensively dispatch Party discipline inspection teams to Party and state organs at the corresponding levels, and, in accordance with regulations, to relevant state-owned enterprises and public institutions. The heads of these discipline inspection teams shall attend relevant meetings of the leading Party organizations of the units in which they are stationed, and their work must be supported by such leading Party organizations.

　　Article 46. Disciplinary inspection commissions at all levels of the Party are specialized organs for intra-Party supervision. Their principal tasks are: to uphold the Party Constitution and other intra-Party regulations; to inspect the implementation of the Party’s line, principles, policies, and resolutions; to assist Party committees in advancing comprehensive and strict governance of the Party, strengthening Party conduct, and organizing and coordinating anti-corruption efforts; and to promote the improvement of the Party and state supervision system.

　　The responsibilities of discipline inspection commissions at all levels of the Party are to conduct oversight, enforce discipline, and hold individuals accountable. They are tasked with regularly educating Party members on observance of discipline and making decisions on upholding Party discipline; overseeing the performance of duties and the exercise of power by Party organizations and leading Party members and cadres; handling complaints and reports from Party members and the general public; conducting talks for reminders, interviews, and written inquiries; investigating and handling relatively important or complex cases in which Party organizations or members violate the Party Constitution and other internal Party regulations, and deciding upon or rescinding disciplinary measures against Party members involved in such cases; initiating accountability procedures or submitting recommendations for pursuing responsibility; receiving complaints and appeals from Party members; and safeguarding the rights of Party members.

　　Discipline inspection commissions at all levels shall report to the corresponding Party committees on issues arising in the handling of particularly important or complex cases, as well as on the outcomes of such handling. Local discipline inspection commissions at all levels and primary-level discipline inspection commissions shall simultaneously report to their superior discipline inspection commissions.

　　When discipline inspection commissions at all levels discover that members of the Party committees at the same level have violated Party discipline, they may first conduct a preliminary verification. If it is necessary to initiate a formal investigation, they shall report to both the Party committee at the same level and the next higher-level discipline inspection commission; if the case involves standing committee members, they shall report directly to the next higher-level discipline inspection commission, which shall conduct the preliminary verification. Where further examination is required, the next higher-level discipline inspection commission shall submit the matter to its corresponding Party committee for approval.

　　Article 47 The higher-level discipline inspection commission has the authority to examine the work of the lower-level discipline inspection commission and to approve or alter the decisions made by the lower-level commission on cases. If the decision of the lower-level commission to be altered has already been approved by its peer party committee, such alteration must be approved by the next higher-level party committee.

　　Local Party discipline inspection commissions at all levels and primary-level discipline inspection commissions, if they disagree with the decisions of their corresponding Party committees on handling cases, may request the next higher-level discipline inspection commission to review such decisions; and if they discover that their corresponding Party committee or any of its members has violated Party discipline, and the corresponding Party committee fails to address the matter or fails to address it properly, they have the right to file a complaint with the next higher-level discipline inspection commission and request its assistance in handling the matter.
