Chapter 3: The Party’s Central Organization

　　Article 19 The National Congress of the Party shall be convened every five years by the Central Committee. If the Central Committee deems it necessary, or if more than one-third of the provincial-level organizations so request, the National Congress may be convened ahead of schedule; unless there are extraordinary circumstances, it may not be postponed.

　　The number of delegates to the National Congress and the procedures for their election shall be determined by the Central Committee.

　　Article 20 The functions and powers of the National Congress of the Party are:

　　(1) To hear and examine the report of the Central Committee;

　　(2) To review the report of the Central Commission for Discipline Inspection;

　　(3) To discuss and decide on major issues of the Party;

　　(4) Amending the Party Constitution;

　　(5) Elect the Central Committee;

　　(6) Elect the Central Commission for Discipline Inspection.

　　Article 21 The powers of the National Congress of Delegates of the Party are as follows: to discuss and decide on major issues; and to make adjustments to and elect additional members of the Central Committee and the Central Commission for Discipline Inspection. The number of Central Committee members and alternate Central Committee members to be adjusted or additionally elected shall not exceed one-fifth of the respective total numbers of Central Committee members and alternate Central Committee members elected by the National Congress of the Party.

　　Article 22 The term of office of each Central Committee of the Party shall be five years. If the National Congress is convened ahead of schedule or postponed, the term of office of the Central Committee shall be adjusted accordingly. Members and alternate members of the Central Committee must have at least five years of Party membership. The number of members and alternate members of the Central Committee shall be determined by the National Congress. When a vacancy occurs among the members of the Central Committee, it shall be filled in order by the alternate members of the Central Committee according to the number of votes they received.

　　The Plenary Session of the Central Committee is convened by the Political Bureau of the Central Committee and is held at least once a year. The Political Bureau reports its work to the Plenary Session of the Central Committee and submits to its oversight.

　　During the intervals between sessions of the National Congress, the Central Committee implements the resolutions of the National Congress, directs all Party work, and represents the Communist Party of China in its external relations.

　　Article 23 The Politburo of the CPC Central Committee, the Standing Committee of the Politburo, and the General Secretary of the CPC Central Committee shall be elected by the Plenary Session of the CPC Central Committee. The General Secretary of the CPC Central Committee must be selected from among the members of the Standing Committee of the Politburo.

　　During the intervals between plenary sessions of the Central Committee, the Political Bureau and its Standing Committee exercise the functions and powers of the Central Committee.

　　The Secretariat of the CPC Central Committee serves as the administrative body of the Political Bureau of the CPC Central Committee and its Standing Committee; its members are nominated by the Standing Committee of the Political Bureau and approved by a plenary session of the CPC Central Committee.

　　The General Secretary of the Central Committee is responsible for convening meetings of the Political Bureau and the Standing Committee of the Political Bureau, and for presiding over the work of the Secretariat of the Central Committee.

　　The members of the Party’s Central Military Commission are appointed by the Central Committee, and the Commission operates under a system of responsibility vested in the Chairman.

　　The central leadership bodies and central leaders elected by each Central Committee shall, during the session of the subsequent National Congress, continue to preside over the Party’s routine work until the subsequent Central Committee elects new central leadership bodies and central leaders.

　　Article 24. The Party organizations of the Chinese People’s Liberation Army shall conduct their work in accordance with the directives of the Central Committee. The Central Military Commission is responsible for the Party’s work and political work within the armed forces and shall make provisions regarding the Party’s organizational structure and institutions in the military.
