Chapter VII Disciplinary Measures for Violations of Organizational Discipline

Article 77: Any violation of the principle of democratic centralism, involving any of the following acts, shall be subject to a warning or a serious warning; in cases of serious circumstances, the penalty shall be removal from internal Party office or probation within the Party:
(1) Refusal to implement or unauthorized alteration of major decisions made by Party organizations;
(2) Violating the rules of procedure by allowing individuals or a small group to make decisions on major issues;
(3) Deliberately circumventing collective decision-making in deciding on major matters, the appointment and removal of important cadres, the arrangement of key projects, and the use of large sums of funds;
(4) Committing violations collectively under the guise of collective decision-making.
Article 78: Where a lower-level Party organization refuses to implement or arbitrarily alters a decision made by a higher-level Party organization, those directly responsible and those with leadership responsibility shall be given a warning or a serious warning; in cases of serious circumstances, they shall be removed from their Party posts or placed on probation within the Party.
Article 79: Those who refuse to comply with decisions made by Party organizations regarding assignment, transfer, or exchange shall be given a warning, a serious warning, or removal from internal Party posts as disciplinary action.
During special periods or emergency situations, anyone who refuses to implement the aforementioned decisions of the Party organization shall be subject to the disciplinary measures of probation within the Party or expulsion from the Party.
Article 80: In the course of disciplinary inspections conducted by Party organizations, if a Party member who is legally and regulatively obligated to testify refuses to do so or deliberately provides false information, and the circumstances are relatively serious, a warning or a serious warning shall be imposed; if the circumstances are serious, removal from Party office, probation within the Party, or expulsion from the Party shall be imposed.
Article 81: Any of the following acts, if the circumstances are relatively serious, shall be subject to a warning or a serious warning as disciplinary action:
(1) Violating the regulations on reporting personal matters and failing to report as required;
(2) Failing to truthfully explain the issues to the organization during organizational talks or written inquiries;
(3) Failing to report one’s whereabouts as required or providing false information regarding one’s whereabouts;
(4) Failing to truthfully complete personal dossier information.
Where any of the acts specified in paragraph 2 of the preceding article is committed in conjunction with the provision of false information to the organization or the concealment of facts, such conduct shall be dealt with in accordance with Article 63 of these Regulations.
Those who tamper with or falsify personal档案 materials shall be given a serious warning; in cases of serious circumstances, they shall be removed from their Party posts or placed on probation within the Party.
Those who conceal serious errors committed prior to joining the Party shall, as a general rule, be expelled; however, those who have been members for many years and have consistently demonstrated good conduct, or who have made outstanding contributions in their work, may be given the disciplinary penalties of a serious warning, removal from internal Party posts, or probation within the Party.
Article 82: Party members who are leading cadres, in violation of relevant regulations, organize or participate in spontaneously formed associations of fellow townsmen, alumni, comrades-in-arms, and the like, and where the circumstances are serious, shall be given a warning, a serious warning, or removal from internal party posts as disciplinary action.
Article 83: Anyone who commits any of the following acts shall be given a warning or a serious warning; if the circumstances are relatively serious, shall be removed from internal Party posts or placed on probation within the Party; and if the circumstances are severe, shall be expelled from the Party:
(1) Engaging in non-organizational activities such as canvassing and assisting candidates in democratic nomination, democratic evaluation, organizational investigation, and intra-party elections;
(2) In voting and election activities prescribed by law, engaging in non-organizational activities that violate organizational principles, and organizing, instigating, or inducing others to vote or cast ballots;
(3) Engaging in other activities during elections that violate the Party Constitution, other internal Party regulations, and relevant statutes.
Those who engage in organized vote-buying or bribery in election campaigns, or who use public funds for such purposes, shall be subject to more severe or aggravated disciplinary measures.
Article 84: In the work of selecting and appointing cadres, any violation of the regulations on cadre selection and appointment—such as nepotism, exclusion of dissenters, offering positions in exchange for favors, interceding or interfering, seeking or lobbying for posts, or making rushed promotions or adjustments of cadres—shall be subject to disciplinary action against those directly responsible and those with leadership responsibility. For less serious cases, a warning or a serious warning shall be imposed; for more serious cases, removal from internal Party office or probation within the Party shall be imposed; and for extremely serious cases, expulsion from the Party shall be imposed.
Where negligence or errors in personnel selection result in serious consequences, the persons directly responsible and those bearing leadership responsibility shall be dealt with in accordance with the provisions of the preceding paragraph.
Article 85 In the work of promoting the healthy rotation of leading cadres—ensuring that those who are capable rise and those who are not capable step down—anyone who engages in “groupism” and commits any of the following acts shall, if the circumstances are relatively serious, be given a warning or a serious warning; if the circumstances are serious, be given the penalty of removal from internal Party posts or probation within the Party:
(1) Avoiding organizational adjustments by means of disciplinary actions within the Party and administrative sanctions;
(2) Replacing disciplinary and administrative sanctions with organizational adjustments;
(3) Other instances of handling matters by avoiding the core issues.
Article 86: In the processes of recruiting and assessing cadres and employees, promoting them to higher positions or ranks, evaluating and conferring professional titles, awarding honors and commendations, conferring academic titles, as well as in conscription and the placement of demobilized military personnel, anyone who conceals or distorts the truth, or who, by abusing their official authority or influence derived from their position, violates relevant regulations to seek benefits for themselves or others shall be given a warning or a serious warning; if the circumstances are relatively serious, they shall be removed from their Party post or placed on probation within the Party; if the circumstances are severe, they shall be expelled from the Party.
Anyone who engages in fraud or falsification to obtain positions, ranks, professional titles, benefits, qualifications, academic credentials, degrees, honors, designations, or other improper advantages shall be dealt with in accordance with the provisions of the preceding paragraph.
Article 87: Any violation of a Party member’s right to vote, right to elect, and right to be elected, if the circumstances are relatively serious, shall be subject to a warning or a serious warning; if the circumstances are serious, shall be subject to removal from internal Party posts.
Anyone who, by means of coercion, threats, deception, enticement, or other such methods, obstructs Party members from freely exercising their rights to vote, to stand for election, and to be elected shall be subject to the disciplinary measures of removal from Party office, probation within the Party, or expulsion from the Party.
Article 88: Any of the following acts shall be subject to disciplinary action as follows: for those directly responsible and those with leadership responsibility, a warning or a serious warning shall be imposed; if the circumstances are relatively serious, removal from internal Party post or probation within the Party shall be imposed; if the circumstances are severe, expulsion from the Party shall be imposed:
(1) Obstructing or suppressing criticism, whistleblowing, or accusations; privately withholding or destroying materials related to such criticism, whistleblowing, or accusations; or deliberately disclosing such materials to others;
(2) Suppressing Party members’ right to make statements in their defense, to defend themselves, or to testify, thereby resulting in adverse consequences;
(3) Suppressing Party members’ appeals, thereby causing adverse consequences, or failing to handle such appeals in accordance with relevant regulations;
(4) Other acts that infringe upon the rights of Party members and result in adverse consequences.
Those who retaliate against critics, whistleblowers, accusers, witnesses, or other persons shall be subject to more severe or aggravated disciplinary measures.
Article 89: Any person who, in violation of the Party Constitution and other internal Party regulations, employs deceitful practices or other means to admit individuals who do not meet the criteria for Party membership, or who issues certificates of Party membership to non-Party members, shall be given a warning or a serious warning; if the circumstances are serious, they shall be removed from their Party posts.
Where Party membership is developed in violation of the relevant prescribed procedures, the persons directly responsible and the persons with leadership responsibility shall be dealt with in accordance with the provisions of the preceding paragraph.
Article 90: Those who, in violation of relevant provisions, acquire foreign nationality or obtain permanent residency or long-term residency permits in a foreign country or region shall be subject to the disciplinary measures of removal from internal Party posts, probation within the Party, or expulsion from the Party.
Article 91: Those who, in violation of relevant provisions, apply for private passports and travel documents for going abroad (or to Hong Kong and Macao), or who enter or exit the country (or border areas) without approval, shall, if the circumstances are relatively minor, be given a warning or a serious warning; if the circumstances are relatively serious, be given the penalty of removal from internal Party posts or probation within the Party; and if the circumstances are severe, be given the penalty of expulsion from the Party.
Where an individual has been approved to travel abroad (or to a border area) for private purposes but subsequently engages in unauthorized changes of itinerary, fails to return on time without justifiable reasons, or otherwise exceeds the scope of the approved travel, and the circumstances are relatively serious, a warning or a serious warning shall be imposed; if the circumstances are severe, removal from internal Party office shall be imposed.
Article 92: Party members in overseas institutions or in temporary delegations (groups) traveling abroad (or to Hong Kong and Macao) who, without authorization, separate themselves from the organization; or party members engaged in foreign affairs, confidential work, military affairs, or other related fields who, in violation of relevant regulations, establish contact or engage in exchanges with foreign organizations or individuals—shall be given a warning, a serious warning, or removal from internal party posts as disciplinary action.
Article 93: Party members in overseas institutions or in temporary delegations (groups) traveling abroad (or to Hong Kong, Macao, and Taiwan) who leave the organization but return voluntarily within six months shall be subject to the disciplinary measures of removal from internal party posts or probation within the Party; if they leave the organization for more than six months, they shall be treated as having voluntarily withdrawn from the Party and shall be expelled from the Party.
Anyone who intentionally provides facilitating conditions for another person to leave the organization shall be given a warning, a serious warning, or removal from internal party office as disciplinary action.
